1. Scope of Services
This agreement applies to all real estate media services ordered by the Client (the real estate agent/broker or homeowner) from BDWdigitalmedia, including but not limited to Real Estate Photography, 3D Virtual Tours, Promotional Videos, and Headshots.
2. Travel & Service Areas
BDWdigitalmedia proudly provides standard services throughout Dallas, Collin, and Kaufman Counties. The Client agrees that any property located outside of these primary service areas is subject to a travel fee, which will be calculated and added to the final invoice before media delivery.
3. Rights and Usage License
All media produced by BDWdigitalmedia is the strictly copyrighted property of the photographer. Upon full payment, the Client is granted a Limited, Non-Exclusive, Non-Transferable License to use the media for the sole purpose of marketing the specific listing address provided. This license expires once the property is sold, leased, or the listing agreement terminates. Media may not be sold, given, or transferred to third parties (including builders, stagers, or other agents) without express written consent from BDWdigitalmedia.
4. Property Readiness & Liability
The property must be clean, staged, and ready for shooting at the scheduled time. BDWdigitalmedia is not responsible for moving furniture, cleaning, or staging. The photographer will shoot the home "as-is." BDWdigitalmedia is not liable for any structural, cosmetic, or environmental flaws visible in the final media.
5. Payment & Image Delivery
Media will be delivered via a secure link. Final high-resolution media will remain locked until full payment is received.
6. Cancellation & Rescheduling
Cancellations or rescheduling requests must be made at least 24 hours in advance. Cancellations made inside the 24-hour window, or a shoot delayed by an unready property, may result in a $50 rescheduling fee. In the event of severe weather, BDWdigitalmedia reserves the right to reschedule exterior shoots to protect equipment and ensure quality.
